NCS Property operates an online property listing and discovery platform that enables property owners, sellers, developers, agents and other authorized persons to list properties and enables prospective buyers and other users to discover properties and submit enquiries.
By accessing or using the NCS Property website, submitting an enquiry, creating an account, or listing a property, you agree to be bound by these Terms & Conditions (“Terms”).
If you do not agree with these Terms, please do not use the website or its services.
## 1. Nature of Our Platform
NCS Property is a digital platform intended to facilitate the discovery of properties and communication between property listers and prospective buyers.
Unless expressly stated otherwise, NCS Property:
* Does not own the properties displayed on the platform.
* Does not sell, purchase, develop, construct or transfer ownership of the properties listed by users.
* Is not a party to any sale, purchase, lease, rental or other transaction between users.
* Does not act as a legal representative of any buyer or seller.
* Does not guarantee the completion or outcome of any transaction between users.
The information relating to individual properties is generally provided by the respective property owner, seller, developer, agent or other lister.
## 2. Property Listings
Property listings displayed on NCS Property may include information such as:
* Property description
* Photographs and videos
* Location
* Property specifications
* Area and dimensions
* Price
* Amenities and facilities
* Availability
* Ownership or developer information
* RERA or other regulatory information, where provided by the lister
* Other information supplied by the lister
Such information is provided by the respective lister and may be subject to change.
NCS Property does not guarantee that any listing is complete, accurate, current, genuine, available or suitable for any particular purpose.
## 3. Responsibility of Property Listers
Any person or entity submitting a property listing to NCS Property represents and warrants that:
1. They have the legal right, ownership or appropriate authorization to advertise the property.
2. The information submitted is accurate and not misleading to the best of their knowledge.
3. They will update information where material changes occur.
4. The photographs, videos, descriptions and other materials submitted by them may legally be used for advertising the property.
5. The listing does not violate any applicable law, regulation, court order or third-party right.
6. They will comply with all applicable laws and regulations relating to the property and the proposed transaction.
The lister remains solely responsible for the property and all representations made in connection with the property.
## 4. No Verification or Endorsement
Although NCS Property may undertake certain checks, moderation or verification measures from time to time, such measures should not be interpreted as a guarantee, certification, endorsement or representation regarding the property or the person listing it.
A property appearing on NCS Property does not necessarily mean that NCS Property has independently verified:
* Ownership or title;
* Title documents;
* Encumbrances or mortgages;
* Government approvals;
* Building permissions;
* RERA registration or compliance;
* Property measurements;
* Construction quality;
* Property condition;
* Taxes, dues or outstanding liabilities;
* Availability;
* Market value;
* Seller identity or authority; or
* Any other information relating to the property.
Users should conduct their own independent legal, financial, technical and physical due diligence before proceeding with any transaction.
## 5. Buyer Responsibility
Prospective buyers are solely responsible for independently verifying all information before making any payment, signing any agreement or entering into any transaction.
Buyers should, where applicable, independently verify:
* Ownership and title;
* Identity and authority of the seller;
* Title documents and chain of title;
* Encumbrances and existing liabilities;
* RERA registration and relevant approvals;
* Government and local authority approvals;
* Property boundaries and measurements;
* Taxes and outstanding dues;
* Physical condition of the property;
* Possession and completion status;
* Price and payment terms; and
* Any other matter relevant to the proposed transaction.
NCS Property strongly recommends obtaining appropriate legal, financial and technical advice before entering into a property transaction.
## 6. Property Enquiries
NCS Property may provide mechanisms through which prospective buyers can submit enquiries to property listers.
An enquiry submitted through the platform:
* Does not constitute an offer to purchase;
* Does not constitute a booking;
* Does not create a contract;
* Does not guarantee a response from the lister; and
* Does not obligate either party to proceed with a transaction.
Any subsequent communication, negotiation, agreement or transaction takes place independently between the relevant parties.
## 7. Transactions Between Users
Any transaction between a buyer and a seller, owner, developer, agent or other property lister is undertaken entirely at the parties’ own discretion and risk.
NCS Property is not responsible for and does not guarantee:
* Completion of a transaction;
* Payment or receipt of money;
* Accuracy of representations made by either party;
* Property ownership or title;
* Possession or delivery of the property;
* Quality or condition of the property;
* Refunds or cancellations;
* Registration of the property;
* Execution or enforceability of agreements between parties;
* Disputes between buyers and sellers;
* Fraud, misrepresentation or concealment by users; or
* Any financial or other loss arising from a transaction between users.
Users should exercise appropriate caution and conduct all necessary due diligence before transferring money or entering into any agreement.
## 8. No Financial or Legal Advice
Information available on NCS Property is provided for general informational and property-discovery purposes.
Nothing on the website constitutes legal, financial, investment, tax, valuation or other professional advice.
Users should obtain independent professional advice where appropriate.
## 9. Pricing and Availability
Property prices, availability, specifications, photographs and other listing information may change at any time.
NCS Property does not guarantee that the price or availability displayed on the website will remain unchanged or that a property will remain available after an enquiry has been submitted.
The final commercial terms of any transaction are determined solely by the parties involved.
## 10. Prohibited Listings and Conduct
Users must not use NCS Property to:
* Publish false or misleading property information;
* List a property without appropriate authority;
* Impersonate another individual or organization;
* Upload forged or fraudulent documents;
* Misrepresent ownership or legal rights;
* Use the platform for unlawful activities;
* Upload content that infringes third-party intellectual property rights;
* Attempt to defraud another user;
* Collect or misuse another user’s personal information; or
* Violate any applicable law or regulation.
NCS Property reserves the right, subject to applicable law, to remove, reject, suspend or restrict any listing or user account where we reasonably believe that the listing or conduct violates these Terms, applicable law or the interests of the platform or its users.
## 11. User-Submitted Content
By submitting photographs, videos, descriptions, text, documents or other content to NCS Property, you confirm that you have the necessary rights and permissions to submit and use such content.
You grant NCS Property a non-exclusive right to host, reproduce, display, publish and use such content for operating, marketing and promoting the relevant listing and the NCS Property platform, subject to applicable law and our Privacy Policy.
## 12. Removal of Listings
NCS Property may remove, disable or restrict access to a listing where:
* The information appears inaccurate or misleading;
* The property is reported as unavailable;
* Ownership or authorization is disputed;
* Fraud or suspicious activity is suspected;
* The listing violates these Terms;
* The listing infringes third-party rights;
* The listing violates applicable law; or
* Removal is required by a competent authority.
Removal or continuation of a listing does not constitute confirmation or denial of ownership or any other legal right in the property.
## 13. Limitation of Liability
To the maximum extent permitted by applicable law, NCS Property shall not be responsible or liable for any direct, indirect, incidental, consequential, special or other loss, damage, cost or expense arising from or relating to:
* Any property listed on the platform;
* Any inaccurate or incomplete information supplied by a user;
* Any transaction between users;
* Any payment made between users;
* Any fraud, misrepresentation or omission by a user;
* Any dispute between a buyer and seller;
* Any loss of money, business, opportunity or anticipated benefit;
* Any inability to complete a transaction; or
* Reliance on information contained in a property listing.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
## 14. Indemnification
To the extent permitted by applicable law, users agree to indemnify and hold harmless NCS Property, its owners, directors, employees, representatives and service providers from claims, losses, liabilities, damages, costs and expenses arising out of or relating to:
* Their use of the platform;
* Their property listing;
* Any inaccurate or misleading information submitted by them;
* Their violation of these Terms;
* Their violation of applicable law; or
* Any transaction or dispute involving them and another user.

NCS Property may contain links or references to third-party websites, services or resources.
NCS Property does not control and is not responsible for the content, availability, accuracy, privacy practices or services provided by such third parties.
Users access third-party services at their own risk and should review the relevant third party’s terms and policies.
## 16. Website Availability
We endeavour to maintain the availability and functionality of the NCS Property website. However, we do not guarantee that the website will always be available, uninterrupted, secure or free from errors.
We may modify, suspend or discontinue any part of the website or its services at any time, subject to applicable law.
